1. On payment of the joining-up fee and making your contribution to the on-line library of the required number of books (see 3 below) you will be entitled, as a member, to full access to the mybookyourbook website enabling you to request books, contained in the library, for a period of 12 (twelve) months from the date you activate your account, the joining-up fee is not refundable accept in circumstance referred to in clause 15. The joining-up fee payable at the time you register will be the amount currently advertised on the website.
  2. In joining up to mybookyourbook you accept and agree to the terms and conditions contained herein and in using the website you are indicating that you fully understand and will abide by them. Failure to do so will result in your membership of mybookyourbook being withdrawn and access to the site will be denied.
  3. The membership is conditional on the member providing ten titles of books in paperback form that they hereby undertake to make available via the mybookyourbook web site library for other members to request, and upon receipt of a stamped addressed envelope agree to send any such requested book(s) to the member(s) who so requested them.
  4. In turn as a member you may request any book or books contained in the library and will be entitled to receive such book(s) from the other member(s) on sending to them a stamped addressed envelope (see "How to receive and send books listed in the library" information sheet ,which will be included in your starter pack).
  5. The number of books requested by and receivable by any member will be limited to a total of five per month.
  6. mybookyourbook has been created to provide a comprehensive database for handling the content of the library and the process of sharing books and their movement among the members and acts as an intermediary in this respect and does not at any time gain or retain title to any books moving among the members except as provided for under the conditions arising in clause number 15 of these terms & conditions. However the member hereby warrants and confirms that the books provided by them to be included in the library are ones to which they have legal title and that they are at liberty to make them freely available to other members.
  7. As a member you further agree that on transferring a book or books to other members the title of ownership to such book or books will pass to the transferee who will hold them on condition that they remain in the mybookyourbook library for other members to request and the same conditions as in 3 above will apply to such books.
  8. All books provided by the member on first registration and on renewal must be in paperback form only and to largely fall into the category of contemporary literature.
  9. All books provided under rule 6 shall be of an acceptable standard and content, in good condition and without any missing, torn or damaged pages or covers.
  10. The Managers of the mybookyourbook catalogue reserve the right to reject any book title offered by a new or existing member if there is already a predetermined number of the same title registered or for any other reason whatsoever it is deemed unsuitable. Books will not be accepted if they contain;
    • Pornographic or obscene material
    • Material that is likely to incite racial hatred against any person or group
    • Defamatory or actionable material
    • Any criminal acts or incitement to commit same
    • Breaches of any applicable law
    The Managers decision on this is final and they shall not be required to give the reason for any such rejection. While every endeavour will be made to ensure that any such harmful or offensive material is not included on the website mybookyourbook cannot accept any responsibility for failure to achieve complete protection against this. Any complaint by a member in respect of unacceptable material placed on the library will be promptly investigated.
  11. On registration the member agrees to:
    • Allow their email address to be made available to another member who requests any book that has been provided by the member under clause 2 above and;
    • On receipt of an email request for a book, the member agrees to supply their name and address to the sender and;
    • Undertakes, on receipt of a stamped addressed envelope from the member making the request for any book title contained in the members list, to place it in the envelope, securely seal it and post it to the member.
    • mybookyourbook undertakes that email exchanges between members as required under the terms of this clause are routed through the website and are validated against the membership database to ensure that they emanate from bona fide members only who can be clearly identified as such.
  12. Books that are transferred from one member to another under rules 3&4 will become listed on the catalogue under the new name of the member who requested it after a period of six weeks. Transferred books cannot, under any circumstances, be subsequently removed and must remain on the mybookyourbook catalogue.
  13. Any member who fails to comply with the rules by not sending a requested book to another member will immediately and automatically be disqualified from membership and will not be entitled to any refund of the joining-up fee relating to the period of any unexpired membership remaining (the books nominated or held by the member will be removed from the catalogue). Where mybookyourbook are required to provide the book or books which the member has failed to transfer then any costs incurred as a result will be payable by the defaulting member. Such costs will be offset by any unexpired proportion of the joining-up fee at the date of disqualification as a member but subject to an additional administration charge of £5.00.
  14. Members on renewing their membership may, if they so wish, add up to three additional titles to their existing catalogue listing. The additional titles so provided must have been published in the last 12 months of first registration or subsequent renewal and for each new title provided the member will be entitled to a discount on the standard fee, in force at the time of renewal, of 10%, subject to a maximum of 30%.
  15. If you wish to cease being a member at the time of renewal of your membership to mybookyourbook then you are free to do so and the joining-up fee for the forthcoming year will not be payable. You must notify us by email or letter of your intention not to renew so that your current list of books can be removed from the library to ensure that the remaining members do not make requests for these. If you choose to leave at any other time prior to the renewal date then you must notify us immediately in writing or by email. Where the member can clearly demonstrate that they are unable to continue using the on-line library for reasons beyond their control or because they are relocating outside the UK postal service area a refund of any unexpired proportion of the joining-up fee for the current membership year will be made. The joining-up fee or part thereof will not be refundable if a member ceases to use the library or respond to book requests from other members for any other reason whatsoever.
  16. All members will be expected to conduct all their actions that relate to using the website in an appropriate manner that will not cause offence or unpleasantness for the other members and will take full responsibility for anything they do while using the various facilities available. They undertake to conform to the rules so that the aims and objectives of mybookyourbook to create a mutually beneficially community are achieved.
  17. Any personal information provided by you will not be disclosed to any other person, persons or organisation by mybookyourbook in accordance with prevailing data protection law accepting that information outlined in clause 11 which will be provided to other members for the purpose of carrying out the transactions relating to the operation of the process of exchanging books as provided for in these terms and conditions. While all normal precautions and controls regarding data protection will be provided mybookyourbook cannot accept responsibly for any personal details which are disclosed through access to the website by any person who is not an authorised employee of mybookyourbook and who acts without their knowledge or consent. All members undertake and agree not to disclose any information in respect of other members that may be made available to them as a member and any member breaching these conditions hereby indemnifies mybookyourbook in respect of any liability, legal costs, damages or other losses which may arise from the breach by any members of these terms and conditions or for any other actions by the member which may result in any legal action being taken by another member or other third party.
  18. All copyright , trademarks and other intellectual property which is contained in or relates to the website including the design, text, graphics and all source codes and software are owned or licensed by mybookyourbook and none of the content may be downloaded, copied, reproduced or otherwise stored, used, sold or distributed without the consent of mybookyourbook.
  19. mybookyourbook accepts no liability nor makes any warranty that the website functionality is error free and while every effort will be made to correct any defects found or notified to them they will not be responsible for any indirect loss or damages whatever arising out of the use of the website. Information contained in the website does not constitute advice that should be relied upon in making any decision or otherwise and is provided purely for the purpose of members being able to carry out the intended transactions for the purpose of exchanging books in accordance with the rules and for no other purpose.
  20. The website may from time to time include links to other websites which are controlled and maintained by third parties and such links should not be construed as an endorsement by mybookyourbook of any such sites as to their content, availability or functionality and mybookyourbook accept no responsibility or liability in respect of these sites and their access or use by members. In accepting these terms and conditions the member agrees that mybookyourbook has no responsibility or liability in this respect.
